1. Introduction
Welcome to VoiceBuy managed by WESY SAS. These Terms and Conditions (“Agreement”) govern your access to and use of our services, including but not limited to Softswitch licensing, VoIP server consultation, GSM Gateway VPN setup, wholesale international voice services, and DID number provision.
By using our services or accessing our platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our services.
2. Definitions
– Company: VoiceBuy managed by WESY SAS.
– Customer: Any individual or business entity who purchases services from VoiceBuy.
– Services: All services provided by VoiceBuy, including licensing, consultancy, VPN setup, traffic termination, and DID numbers.
– Website: The online platform owned and operated by VoiceBuy.
3. Scope of Services
(a) We offer services related to VoIP technologies, including but not limited to: softswitch licensing, consultancy for VoIP server setup, GSM Gateway VPN solutions, international wholesale VoIP traffic, and DID number services.
(b) Services are available 24/7 unless interrupted by maintenance, upgrades, or force majeure circumstances.
(c) The addition of new services or modifications to existing ones may be made from time to time, subject to updated Terms and Conditions.
4. Customer Obligations
(a) Customers must provide accurate, up-to-date information when registering.
(b) Customers are responsible for the security of their accounts and passwords.
(c) Customers must use services legally and ethically without violating any local or international laws.
5. Term, Suspension, and Termination
(a) The Agreement begins on the date the Customer registers or purchases a service and continues until terminated.
(b) We reserve the right to suspend services if your account balance reaches zero or if there is a breach of these Terms.
(c) All services associated with the account will be automatically suspended if invoices remain unpaid for more than 4 days, and will only be reactivated once all outstanding dues are settled.
6. Payment and Billing
(a) All services are prepaid unless otherwise agreed.
(b) Payments are accepted via bank transfer and approved electronic payment gateways.
(c) All billing and accounting will be conducted in Euro (€). Bank charges are borne by the Customer.
(d) Customers must raise any invoice disputes within 10 days of issuance.
(e) Billing is based only on successfully completed traffic.
7. Refund Policy
(a) All payments made to VoiceBuy managed by WESY SAS are final and non-refundable. No refunds will be issued under any circumstances, including dissatisfaction, unused balance, or suspension/termination of services.
(b) By making a payment, you acknowledge and agree to this No Refund Policy.
8. Technical Standards and Responsibilities
(a) Each Party is responsible for providing the necessary telecommunications and server infrastructure.
(b) Failures or issues should be addressed promptly and professionally.
9. Intellectual Property
(a) All content, trademarks, software, and intellectual property on the Website are owned by VoiceBuy or its licensors.
(b) Unauthorized use of our intellectual property is strictly prohibited.
10. Confidentiality
Both parties agree to maintain the confidentiality of all exchanged data, technical information, credentials, and agreements, except when disclosure is required by law.
11. Force Majeure
Neither party shall be liable for failures caused by events beyond their control, including natural disasters, wars, acts of government, and power outages.
12. Limitation of Liability
(a) VoiceBuy shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the services.
(b) The maximum liability under any circumstance shall not exceed the amount paid by the Customer for the affected service.
13. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of France. Any disputes will be resolved through arbitration under French law.
14. Changes to Terms
VoiceBuy reserves the right to update or modify these Terms at any time. Notice of changes will be posted on the Website 30 days before they become effective.
